Meetings

Resolution #963 - to permit and regulate public comment at public meetings, adopted 1/18/2024.


All Township meetings are held at the Township Building, 110 Sunday Drive.

Submissions should be received in the Office ten (10) days prior to meeting.

Meetings dates and times are scheduled as follows, unless otherwise advertised.  

TOWNSHIP SUPERVISORS - 3rd Thursday of each month at 7pm

SEWER AUTHORITY - 3rd Monday of each month at 7pm

PLANNING COMMISSION - 3rd Tuesday of each month at 7pm (on an as needed basis only)

The front entrance of the Municipal Building allows access to the offices of the Township, Sewer Authority, and Tax Collector.  The Police Department is located on the right rear side of the Township Building.  The front entrance is also accessible for the handicapped.

Right to Know

Open Records Officer - The Township hereby designated Alice Hummel and John Blake, as the Township Open Records Officers.   The Open Records Officers may be reached at:  110 Sunray Dr., Suite 1, Johnstown, PA  15905 Phone (814) 255-5243 FAX (814) 255-1805 or by e-mail:  uytwp@atlanticbbn.net

General - All documents deemed public records shall be available for inspection, retrieval, and duplication at the Municipal Building during established business hours 9:00 a.m. – 3:00 p.m. Monday through Friday with the exception of weekends and holidays.

Requests - Requests shall be made in writing to the township Open Records Officer on a form provided by the Township.  (See attached form)

Fees - Paper copies shall be $.25 cents per page per side.  The certification of a record is $1 per record.  Specialized documents including, but not limited to blue prints, color copies and non-standard sized documents shall be charged the actual cost of production.  If mailing is requested, the cost of postage will be charged.  The Township shall require prepayment if the total fees are estimated to exceed $100.

Response - The Township shall make a good-faith effort to provide the requested public record(s) as promptly as possible.  The Open Records Officer shall cooperate with those requesting records to review and/or duplicate original Township documents while taking reasonable measure to protect Township documents from the possibility of theft, damage, and/or modification.

The Open Records Officer shall review all written requests for access to public records.  As soon as possible, but no later than five business days after receiving a written request to access public records, the Open Records Officer shall respond to such requests in writing consistent with Act 3 of 2008, the Right-to-Know Law.

 If access to a record is denied, the response shall include a reason for denial as stipulated in Act 3 of 2009, the Right-to-Know Law.

Landlord Responsibilities

Be aware of unpaid charges that may be against your property.  Water, sewer, and garbage/recycling collection charges, if left unpaid, will remain against the property representing a municipal lien.  These services were provided for the residents of the property and will remain with that property until they are paid.  If you have tenants residing in your rental properties, we urge you to check with all offices for unpaid bills.  If you purchased your property, your settlement agency and/or attorney should have checked with these offices to obtain a municipal lien letter which states all prior fees have been paid in full.  Your property is one of your biggest investments.  Take steps to protect your interest by contacting the Township office(814-255-5243), and the Greater Johnstown Water Authority (814-533-4300).

Ordinances

The Supervisors of Upper Yoder Township adopt Ordinances as needed to facilitate the municipal services that are provided to the residents/guests of the Township.  At present, the Board of Supervisors, both past and present, have a total of 264 Ordinances on record covering a myriad of topics.  Listed below are a few of the Ordinances that have been of special interest to residents and inquiring minds.

BUSINESS PRIVILEGE TAX - Ordinance No. 166 adopted Dec. 1978, as amended, with the latest edition as Ordinance No. 238 adopted Nov. 1996 establishes the tax rate and collection procedures for this tax. 

EARNED INCOME TAX - Ordinance No. 68 adopted Oct. 1964 as amended with the latest edition being Ordinance No. 87 adopted Sept. 1966. establishing the tax rate and the collection procedures.

EXCAVATION ORDINANCE - Ordinance No. 210 adopted Dec. 1989 as amended with the latest edition as Ordinance No. 231 adopted Sept. 1993 establishes the regulations for obtaining a permit for any type of moving of earth within the Township.

FIRE DAMAGED PROPERTIES - Ordinance No. 229 - adopted Oct. 1992 established the regulations for maintenance and disposition of fire damaged properties within Upper Yoder Township as mandated under State Act 98.

GARBAGE COLLECTION ORDINANCE  - Ordinance No. 224 - adopted Aug. 1991 (current edition) and revised by Ordinance No. 233 Nov. 1993 to establish the regulations concerning the collection of garbage/refuse within the Township.

INTERNATIONAL BUILDING CODE - Ordinance No. 258 adopted Jan. 2003 enforcing the requirements of adhering to the International Building Codes for any development within the Township

LAND DEVELOPMENT/SUBDIVISION  - Ordinance No. 23 as amended, original ordinance establishing the regulations for land development/subdivision in the Township.  This ordinance has been amended several times with the latest edition being Ordinance No. 219 adopted Sept. 1990.

LOCAL SERVICES TAX - Ordinance No. 264 adopted Dec. 2007 establishes the tax rate and collection procedures for this tax.

MERCANTILE TAX - Ordinance 167 adopted Dec., 1978, as amended, with the latest edition as Ordinance No. 169 adopted May, 1979. establishes the tax rate and collection procedures for this tax.

MOVING PERMIT ORDINANCE - Ordinance No. 186 adopted Nov. 1982 to require anyone moving into, out of, or within the Township to file an application with the Township office and pay the applicable fee.

NUISANCE ORDINANCE  - Ordinance No. 245 - adopted March, 1999 is a comprehensive ordinance the covers a variety of topics that may cause disturbances to the other neighbors in the area.

PEDDLER'S PERMIT ORDINANCE - Ordinance No. 91 adopted Nov. 1966 as amended with the latest version as Ordinance No. 251 adopted April, 2001. establishes the regulations for solicitation within the Township

PER CAPITA TAX - Ordinance No. 15 - adopted March, 1959 creating the Per Capita Tax collected by the Upper Yoder Township Tax Collector.  This original ordinance has been amended over the years with the latest edition being Ordinance No. 180 adopted Nov. 1981.

PLANNING COMMISSION - Ordinance No. 22 - adopted March, 1960 creating the Upper Yoder Township Planning Commission

REALTY TRANSFER TAX - Ordinance No. 21 - adopted Jan. 1960 creating revenue for the Township by the adoption by a 1% Realty Transfer Tax.  Ordinance has been amended with the latest edition issued Feb. 2007 - Ordinance No. 263.

RECYCLING COLLECTION ORDINANCE - Ordinance No. 223 - adopted Aug. 1991 (current edition) and revised by Ordinance No. 234 Nov. 1993 to establish the regulations concerning the collection of recycling items within the Township.

SEWER COMPLIANCE ORDINANCE - Ordinance No. 265 adopted Jan. 2009 establishing requirements for the inspection and certification of sanitary sewers at the time of sale, transfer, assignment, mortgage or refinancing, of any real property located within the Township of Upper Yoder or the Upper Yoder Township Authority sanitary sewer collection system, providing conditions for the issuance of municipal lien letters and establishing fees and procedures for the issuance of such certificates and lien letters and providing penalties for the failure to comply with said procedures.  In summary, all residences that are in transition between owners, or refinancing, must obtain a Sewer Compliance Certificate to ensure the property is in compliance with the Authority's Sewer Rules and Regulations.  Application and fees are listed under "sanitary sewers" section of this website.

STATE BUILDING CODE - Ordinance No. 261 adopted April, 2004 enforcing the requirements of adhering to the State Building Codes for any development within the Township

STORMWATER MANAGEMENT ORDINANCE - Ordinance No. 288 adopted March 16, 2023,  establishes the regulations for the management or Stormwater within the Township

TIMBER ORDINANCE - Ordinance No. 188 adopted April, 1983 and amended with the latest edition as Ordinance No. 259 adopted in Dec. 2003.

UPPER YODER TWP. AUTHORITY  -Ordinance No. 8 & 9 - adopted Oct. 1956 established the Upper Yoder Township Authority and granted the Authority the powers to install and maintain the sanitary sewer system and pumping stations in the Township.

UPPER YODER TWP. AUTHORITY   - Ordinance No. 11 - adopted Jan. 1957 established the Upper Yoder Township Authority and granted the Authority the powers to install and maintain the public water system in the Township.  The Township's public water system has since been turned over to the Greater Johnstown Water Authority and the Upper Yoder Township Authority Board is no longer active.

ZONING ORDINANCE - Ordinance 1 adopted 1952 as amended with the latest edition as Ordinance No. 252 adopted May, 2001 establishes the land regulations/usage concerning development within the Township.
